What marketing agencies usually carry

  • Media liability
  • Professional liability (E&O)
  • Cyber liability
  • Crime and social engineering
  • Business owner’s policy
  • Employment practices liability
  • Hired and non-owned auto

Watch for these in a marketing agency’s policy

  • Texts, calls, and email listsClaims over unsolicited texts, calls, or faxes are excluded by most policies. Keep consent records for every list you send to.
  • Photos, music, and fontsUsing a photo, song, or font beyond its license is copyright infringement. Media liability answers many such claims, though unpaid license fees are usually excluded.
  • Money for media buysIf you hold client money for ad placements, a spoofed invoice can send it to a thief. Social engineering coverage is often a small sublimit.
  • Influencer postsSponsored posts that hide the payment can bring regulator action. Defense may be covered, but fines and penalties usually are not.
  • Comparison adsAds that name or compare a competitor draw trademark and disparagement claims. Confirm both are in your media coverage.

What brand clients ask marketing agencies for

  • Media liabilityBrand contracts often ask for it by name, with the client as additional insured for claims over content you create.
  • Indemnity for your workClients ask you to stand behind what you deliver. Keep it to infringement you cause, which your media policy can answer.
  • Cyber and account securityIf you run their customer lists or ad accounts, clients may ask for cyber limits and how you secure logins.
  • Professional liabilityLarger clients often set a minimum limit for mistakes like a wrong ad run, a missed launch, or an overspent budget.

Questions marketing agencies ask

Straight answers.

The questions we hear most, answered plainly.

What is the difference between media liability and E&O?

Media liability answers claims about content: copyright, trademark, defamation, and privacy. E&O answers claims that your service failed, like a campaign that ran wrong. Most agencies need both.

Is a client’s lost revenue from a failed campaign covered?

If they claim your error caused it, E&O can defend and pay it. A campaign that simply underperforms, with no mistake, is usually not a covered claim.

Are freelancers we hire covered?

Your policy usually covers the agency’s liability for their work, but not the freelancers themselves. Ask for their own coverage, and have their contracts assign you the rights.

How fast can I get a certificate?

Once your policy is bound, you request certificates from your client login, with the wording your contract asks for.

Can I pay monthly?

Yes. Most policies can be paid in full or monthly.
