Insurance for real estate agents and brokers.
Real estate errors and omissions, cyber for closing wire fraud, and general liability for agents, teams, and small brokerages, whether or not your brokerage covers you.
What real estate agents usually carry
- Real estate errors and omissions
- Cyber and wire fraud
- General liability
- Business owner’s policy
- Hired and non-owned auto
- Employment practices liability
Watch for these in a real estate E&O policy
- Fair housing claimsDiscrimination complaints are common, and some policies pay only the defense, never damages or fines. Read that section before you rely on it.
- Property managementMany agent policies exclude managing rentals unless it is listed. Collecting rent and handling repairs are a different exposure from selling.
- Your own dealsBuying, selling, or flipping property you or your family own is often excluded, or covered only when your interest was disclosed in writing.
- Mold, lead paint, and radonMany policies exclude or sublimit disclosure claims over these, even though they are common complaints after closing.
- Diverted down paymentsA spoofed email sends a buyer’s funds to a thief, and the buyer blames you. E&O often excludes it; cyber with social engineering coverage is what answers.
What brokerages and relocation companies ask real estate agents for
- Your own E&OBrokerages without a group policy often require each agent to carry it, at a limit they set.
- Auto liabilityAgents drive clients to showings, so many brokerages set a minimum auto limit and ask to see proof.
- E&O for relocation workRelocation companies often require it at a set limit before they refer transferring employees.
Questions real estate agents ask
Straight answers.
The questions we hear most, answered plainly.
Does my brokerage’s E&O cover me?
If you are listed on it, usually yes for deals done there. Check the per-claim deductible, since many brokerages pass it to the agent on the deal.
Is a claim that I hid a defect covered?
Claims of negligent misrepresentation are the core of real estate E&O. Deliberate fraud is excluded, though many policies defend you until fraud is proven.
Does my E&O follow me if I change brokerages?
A policy in your own name moves with you. Under a brokerage’s group policy, past deals stay with that policy, so ask how it treats agents who leave.
Can I pay monthly?
Yes. Most policies can be paid in full or monthly.
